The Supreme Court Ruling on the legal definition of a "woman" in the Equality Act 2010

Following the recent judgement in the Supreme Court regarding the legal definition of a "woman" with regards to the Equality Act 2010, we wish to offer our full support to all trans, non-binary and intersex people who are feeling scared about how this will impact their everyday lives. ⚧️ 



This judgement has created a lot of uncertainty about the practical application of it, particularly with regards to same-sex spaces and services. There is a lot of conflicting advice being given at the moment, much of it incorrect and being shared by those with a vested interest in excluding people. To be clear, Constructing Rainbows' focus has always been on inclusion, and before we advise our clients we are waiting for more clarity and practical guidance from the legal profession, EHRC and charities working in this space. We are looking at how we continue to ensure trans, non-binary and intersex people feel included within this new legal framework.



This judgement has raised so many questions, and organisations should not be rushing to make policy changes until some of them have been answered, which may take days, weeks, months or even years as this is sorted out both in the court room and parliament. In the meantime your immediate focus should be with your trans, non-binary and intersex colleagues who may need additional support at this worrying time.
